{"id":52,"date":"2026-04-07T13:31:17","date_gmt":"2026-04-07T12:31:17","guid":{"rendered":"https:\/\/www.gov.fk\/legalservices\/?page_id=52"},"modified":"2026-04-21T12:51:40","modified_gmt":"2026-04-21T11:51:40","slug":"prosecution-criminal-law","status":"publish","type":"page","link":"https:\/\/www.gov.fk\/legalservices\/government-legal-services\/prosecution-criminal-law\/","title":{"rendered":"The Prosecution Service"},"content":{"rendered":"\n<div class=\"wp-block-group has-global-padding is-layout-constrained wp-block-group-is-layout-constrained\"><div class=\"yoast-breadcrumbs\"><span><span><a href=\"https:\/\/www.gov.fk\/legalservices\/\">Home<\/a><\/span> \u00bb <span><a href=\"https:\/\/www.gov.fk\/legalservices\/government-legal-services\/\">Government Legal Services<\/a><\/span> \u00bb <span class=\"breadcrumb_last\" aria-current=\"page\">The Prosecution Service<\/span><\/span><\/div><\/div>\n\n\n\n<div style=\"height:4vh\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n<h1 class=\"wp-block-post-title\">The Prosecution Service<\/h1>\n\n\n<div style=\"height:1vh\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<div class=\"wp-block-group has-global-padding is-content-justification-left is-layout-constrained wp-container-core-group-is-layout-04d632e2 wp-block-group-is-layout-constrained\">\n<p>The Prosecution Service prosecutes criminal cases that have been investigated by the Royal Falkland Islands Police and other Government Departments, such as the Department of Natural Resources in relation to fisheries protection.<\/p>\n\n\n\n<p>The head of the Prosecution Service is the Attorney General.&nbsp; Under the Constitution the prosecution of cases must be conducted independently.&nbsp; This means that the Prosecution Service makes decisions independently of the Police and Government.<\/p>\n\n\n\n<p>The duty of the Prosecution Service is to make sure that the right person is prosecuted for the right offence, and to bring offenders to justice wherever possible.<\/p>\n\n\n\n<p>The work of the Prosecution Service includes:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>deciding which cases should be prosecuted;<\/li>\n\n\n\n<li>determining the appropriate charges;<\/li>\n\n\n\n<li>advising the police during the early stages of investigations; and<\/li>\n\n\n\n<li>preparing cases and presenting them at court.<\/li>\n<\/ul>\n\n\n\n<p>Prosecutors must be fair, objective and independent. When deciding whether to prosecute a criminal case, prosecutors must follow the Attorney General\u2019s Code for Prosecutors.
