Who can apply and how do I apply?<\/h2>\n\n\n\n

Applying for the legal right to deal with someone\u2019s property, money and possessions (their \u2018estate\u2019) when they die is called applying for a grant of representation.<\/p>\n\n\n\n

If the person left a will, you\u2019ll get a \u2018grant of probate\u2019.<\/p>\n\n\n\n

If the person did not leave a will, you\u2019ll get \u2018letters of administration\u2019.<\/p>\n\n\n\n

If the person left a will, but you are not the named executor, you’ll get a grant of ‘letters of administration with the will annexed’.<\/p>\n\n\n\n

In the Falkland Islands, a grant of representation will always be required to deal with the estate of the person who has died and to  give permission to make contact with each asset holder (for example, bank or insurance).<\/p>\n<\/div>\n\n\n\n

Who can apply<\/h2>\n\n\n\n

If the person left a will<\/h3>\n\n\n\n

You can apply if you\u2019re an executor – someone named in the will, or in an update to the will (a \u2018codicil\u2019), as a person who can deal with the estate.<\/p>\n\n\n\n

You will need the will and any codicils to apply.  These must be original documents, not photocopies.<\/p>\n\n\n\n

The person who died should have told all executors where to find the original will, for example:<\/p>\n\n\n\n
